Terms and Conditions

The Client must agree to the terms and conditions of Greenash Systems Limited here under referred to as GSL.

1.

A non-refundable deposit shall be paid in advance.

 
2.

Once a brief of requirements has been received from The Client, either verbal or written, GSL will produce a quotation detailing the work to be carried out. The Client shall provide written confirmation that the quotation is acceptable by signing and returning a copy of the quotation. This will effectively form the basis of the agreement.

 
3.

The Client guarantees that all elements of text, graphics, photographs, designs, trademarks, or other art work forwarded to GSL for inclusion in the website are owned by The Client. GSL cannot take responsibility for any copyright infringements caused by materials submitted by The Client. GSL is not responsible for any lawsuit or other action arising from the use of such material.

 
4.

GSL will produce and publish a draft design website for The Client's review. When The Client has approved the design GSL will then develop the full website.

 
5.

Final payment will be due 28 days after the completed website has been placed on the internet, there are no exceptions. If payment is not forthcoming GSL shall be entitled, at its sole and absolute discretion, to withhold provision of any goods of services it would otherwise be obliged to provide under the agreement. Non payment shall result in legal action being taken if necessary.

 
6.

The Client is expected to fully test the website. Where 'bugs', errors or other issues are found within 30 days after the site has gone live, GSL will endeavour to correct these issues to meet the standards of function outlined in the brief.

 
7.

GSL will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.

 
8.

Despite the best efforts of GSL errors in website information may occur. At no time will GSLs responsibilities for accidentally including erroneous information extend beyond correcting the error.

 
9.

GSL will endeavour to ensure that the website will function correctly on the server it is initially installed on and that it will function correctly when viewed on many web browsers, but GSL cannot guarantee correct functionality with all browsers.

 
10.

GSL cannot guarantee that the functions contained in the website will be error free. The entire risk as to the quality and performance of the website is with The Client. In no event will GSL be liable to The Client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate this website.

 
11.

Whilst GSL recommends hosting companies to host websites, no guarantees can be made as to the availability or interruption of this service. GSL cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service, or for loss of turnover, sales and revenue etc.

 
12.

The Client understands that any Internet Service Provider (ISP) services or website storage services will require a separate contract with the ISP.
